Clarification / Revision

We should reexamine this page and ensure that we are covering all the bases. I believe that something should be included here to indicate that all the content on these pages is copyright Paizo and used with permission and that its inclusion on the wiki is not a challenge to Paizo's ownership of the IP. Also, I think the GNU license works against this, and we might consider taking that off, though I believe that would make us unable to use other GNU Open Documentation on this site, such as using generic Wikipedia templates or text from another wiki. -- Yoda8myhead 05:33, 24 February 2009 (UTC)

The following is a proposed PathfinderWiki policy, guideline, or process.
The proposal may still be in development, under discussion, or in the process of gathering consensus for adoption. References or links to this page should not describe it as "policy".

A proposal's acceptance or rejection is not determined simply by counting votes.

Some elements of the Pathfinder campaign setting canon were licensed by Paizo from another company, such as the Elder Mythos elements in Strange Aeons. As such, those elements are not available for us to use under the CUP, but may be documented under fair use.

I propose amending the Contributions section of the policy to note these exceptions (additions in bold, removals struck):

Use of certain Paizo Inc. intellectual property on PathfinderWiki is licensed under the Community Use Policy (CUP) and either the Open Gaming License (OGL) or Open RPG Creative license (ORC). Its inclusion on the wiki is not a challenge to Paizo's ownership of their intellectual property, and any derivative work must also be released under these two licenses the CUP and the appropriate game license for the source.

Note that some canon elements published in Paizo works are not owned by Paizo. For example, certain Elder Mythos elements in the Strange Aeons Pathfinder Adventure Path are not available in the public domain, and Paizo licensed those elements from Chaosium Inc. While these elements are canon parts of the campaign setting and can be documented on PathfinderWiki as allowed by fair use doctrines, neither PathfinderWiki nor Paizo can release or relicense these canon elements under the CUP.
When documenting such elements, contributors should designate in the article's References section the original source of the element if possible, and note that the content was used by Paizo under license from another publisher. Provide only necessary details in the article; if additional context would be useful, include it on the article's Meta page and link to it from the References section note.

While not part of this policy proposal, PathfinderWiki:Fair use should also be updated accordingly, particularly:
To show our respect and gratitude, we tacitly agree not to push the limits of their good faith by claiming fair use on content they have specifically withheld from the Community Use Package.
